Data category, purpose of processing and legal bases

Storing access data in server log files

You can visit our websites without having to provide personal details. We only save access data in so-called log files which, for example, give the name of the file requested, the date and time of request, the transferred data volume and the requesting provider. These data are evaluated exclusively to ensure trouble-free operation of the site and to improve our services and do not permit identification of your person (legal basis: Art. 6 I, s. 1, subs. f of the General Data Protection Regulation).

Data recording and use for contract processing and opening a customer account

We record personal data if these are given by you on a voluntary basis as part of ordering, making contact (i.e. via contact form or e-mail) or when opening a customer account. The data recorded is indicated on the entry forms in each case. We use the data provided by you for contract processing and handling your queries (legal basis: Art. 6 I, s. 1, subs. b of the General Data Protection Regulation). After full completion of your contract or deletion of your customer account, your data are blocked for further use and deleted after the safekeeping period required by tax and trading laws has expired, in as far as you have not agreed expressly to further use of your data or in as far as we have reserved extended use of the data which is permitted legally and about which we are informing you in the following. Deletion of your customer account is possible at any time, either by a message to the contact option for the Co-ordinator described above or via the appropriate function of the customer account.

Use of data for postal promotions and your right of objection

In addition, we reserve the right to save your first name and surname, your postal address and - in as far as we have received additional data from you in connection with a contractual arrangement - your title, academic degree, your year of birth and your professional, industry or business description in collated lists and to use these for own promotional purposes, i.e. for sending you interesting offers and information about our products by mail (legal basis: Art. 6 I, s. 1, subs. f of the General Data Protection Regulation). Our legitimate interest in the use of the data consists in the reinforcement of customer loyalty and the provision of information to our customers. You can object to the storage and use of your data for these purposes at any time by sending a message to the contact option for the Co-ordinator described above.

Use of data for e-mail promotions without newsletter subscription and your right of objection

If we receive your e-mail address in connection with the sales of goods or services and without your objection, we reserve the right to send you offers by e-mail on a regular basis on products in our portfolio similar to those already purchased. Our legitimate interest in the use of the data consists in the reinforcement of customer loyalty and the provision of information to our customers. You can object to the use of your e-mail address at any time by sending a message to the contact option for the Co-ordinator described above or via the appropriate link in the promotion mail without incurring any costs other than the transmission costs according to the base tariffs (legal basis: Art. 6 I, s. 1, subs. f of the General Data Protection Regulation).

Credit check and scoring

In as far as we deliver in advance, for example, when purchasing on account, we reserve the right to obtain an identity and credit check from specialised service providers (credit agencies) to safeguard our legitimate interests (legal basis: Art. 6 I, s. 1, subs. f of the General Data Protection Regulation).. The credit check may contain probability values (scores) which are calculated on scientifically acknowledged mathematical, statistical methods and where the calculations may also include address data. We shall use the information obtained on the statistical probability of payment default for a balanced decision on justification, execution or termination of the contractual relationship. Your legitimate interests will be taken into consideration in accordance with legal requirements.

Order processing

In the utilisation of IT services and hosting services, personal data may be disclosed in the course of order processing due to the conclusion of a corresponding agreement for order processing (Art. 28 of the General Data Protection Regulation). Our legitimate interest here consists in maintaining the functionality of our IT systems (legal basis: Art. 6 I, s. 1, subs. f of the General Data Protection Regulation). Further processing on our behalf is only undertaken for the purposes of order processing due to the conclusion of an appropriate agreement under Art. 28 of the General Data Protection Regulation, and only on the basis of the facts of Art. 6 I, s. 1 of the General Data Protection Regulation.

Transfer of personal data to independent Co-ordinators

We reserve the right to transfer the personal information to independent co-ordinators for the use of third-party professional services.
For the purposes of contract fulfilment, we pass your data to the commissioned shipping company in as far as this is necessary to deliver the ordered goods. To process payment, we pass the required payment data to the financial institution involved in the payment process and, if applicable, to the payment services provider commissioned by us or the payment service provider selected by you in the order process (legal basis: Art. 6 I, s. 1, subs. b of the General Data Protection Regulation).
Likewise, we may also pass your data to professionals obligated to confidentiality (tax consultants, solicitors, external company medical officers, auditors) in order to safeguard our legitimate interests (legal basis: Art. 6 I, s. 1, subs. f of the General Data Protection Regulation) and to fulfil our statutory obligations (legal basis: Art. 6 I, s. 1, subs. c of the General Data Protection Regulation). Here, our legitimate interests are in the assertion, exercise or defence of legal entitlements and in securing an orderly flow of operations and in compliance with statutory obligations.

Data storage term

The term of storage of your data is determined by the lapse of the purpose for which these are processed. The data will not be deleted if the processing is required for the exercise of the right to free expression and information, the fulfilment of a statutory obligation, on the grounds of the public interest or for the assertion, exercise or defence of legal entitlements.

This also includes the statutory duty to document and to preserve records in accordance with commercial law and the Revenue Code, as well as the statutes of limitations in accordance with the (German) Civil Code (BGB).

Your rights

You have the right:

  • to receive information from us concerning the personal data regarding you and processed by us. Here, the provisions of Art. 15 of the General Data Protection Regulation and of Art. 34 of the (German) Federal Data Protection Act, as amended, are to be observed;
  • to require the immediate rectification by us of incorrect personal data or the completion by us of your personal data stored with us;
  • to require the immediate deletion by us of the personal data regarding you in accordance with Art. 17 of the General Data Protection Regulation;
  • to require restriction by us of the processing of the personal data regarding you if the accuracy of the data is contested by you, the processing is unlawful but you decline the deletion of the data, the data is no longer required by us but you require the data for the assertion, exercise or defence of legal entitlements or if you have lodged an objection under Art. 17 of the General Data Protection Regulation;
  • to lodge an objection to the processing of the personal data regarding you under Art. 21 of the General Data Protection Regulation;
  • to maintain the personal data regarding you under Art. 21 of the General Data Protection Regulation in a structured, up-to-date and machine-readable format;
  • to withdraw your consent under Art. 7 III of the General Data Protection Regulation, granted to us once and for the future;

Provision of personal data

We require from you only the personal data which are required in order to fulfil the contractual relationship or on the grounds of statutory provisions. Without these data, we are unable to complete the contract. Data which you are able to provide for us voluntarily are indicated as such.

Use of cookies

To make a visit to our website attractive and to enable the use of certain functions, we use so-called cookies on various pages of the site. These are small text files which are stored on your terminal. These user profiles serve to analyse user behaviour and are analysed for the improvement and needs-related design of our services. Cookies may be used for these purposes. The anonymised user profiles are not merged with the personal data of the anonymised person without explicit consent which needs to be given separately. Integration of the Trusted Shop Trustbadge

The Trusted Shop Trustbadge has been integrated into this website. This means that our Trusted Shop quality label can be displayed, as well as reviews that may have been gathered. Trusted Shop products can also be offered to buyers after completion of an order. This serves to maintain optimal marketing of our products by assessing a justifiable legitimate interest. The Trustbadge and its advertised services are offered by Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne. When the Trustbadge is activated, the web server automatically saves a so-called server log-profile, which contains, e.g., your IP address, date and time of your transmission, the data volume transmitted and accessing provider (access data), and documents the transmission. This access data is not evaluated and will be overwritten at the latest seven days after the end of your visit to the website. Further personal data will only be transmitted to Trusted Shops if you decide to use Trusted Shops products after completing your order or if you have already registered to use them. When you visit the website, Google receives data such as protocol data, site-based information and application numbers. The data may also be processed in the USA. Right of objection under Art. 21 of the General Data Protection Regulation

You have the right, on grounds arising from your particular situation, to lodge an objection to the processing of personal data regarding you, which is performed on the grounds of Art. 6 I, s. 1, subs. f of the General Data Protection Regulation (processing on the grounds of legitimate interest) or Art. 6 I, s. 1, subs. e of the General Data Protection Regulation (processing in the public interest) at any time. This also applies to profiling based on these provisions.

Should you lodge an objection, we will no longer process your personal data unless we are able to demonstrate compelling grounds worthy of protection for the processing which outweigh your interests, rights and freedoms or the processing serves the assertion, exercise or defence of legal entitlements.

Should personal data be processed by us for the purposes of direct advertising, you have the right to lodge an objection to this processing at any time. This also applies to profiling if it is associated with this direct advertising.
